O-1A Visa

Are you an exceptional individual with national or international recognition in sciences, education, business, or athletics? Consider the O-1A visa as your key to continuing your professional life in the U.S. At Oguz Law, we provide comprehensive guidance to individuals with extraordinary ability in their fields from around the globe at every stage of their O-1A visa processes, helping them seize the opportunities awaiting them in the U.S.

What is the O-1A Visa?

The O-1A visa is a non-immigrant visa category for foreign nationals who have demonstrated extraordinary ability in their fields, such as sciences, education, business, or athletics. This visa is tailored for those recognized nationally or internationally for their achievements.

Who Qualifies for the O-1A Visa?

To qualify for the O-1A visa, individuals must meet specific criteria, including:

Major Awards or Recognition

Applicants must show evidence of major awards or a high level of achievement recognized by experts in the field.

Published Work

Contributions to professional journals, publications, or other significant media relating to the field.

Leading or Critical Role

Playing a leading or critical role in distinguished organizations.

High Salary or Remuneration

Earning a high salary in comparison to others in the field.

How Does the Application Process Work?

Step 1: Initial Consultation and Eligibility Assessment

We evaluate if the applicant qualifies for the O-1A visa by examining the eligibility of their field and work and determining the likelihood of proving their extraordinary ability in the field.

Step 2: Completion of Intake Questionnaires and Document Checklist

We provide both the employer and employee with intake questionnaires, a checklist of required documents, and a sample job description to help them obtain the necessary information for applying for the O-1A visa. Once they have completed these materials, we request that the applicant share the questionnaires, essential documents, and job description with us.

Step 3: Document Preparation and Review

We and the applicant collaborate to identify potential support letter writers for the O-1A petition and analyze the content of support letters. Once we finalize the list of potential writers, the applicant starts gathering drafts of support letters. We then review the documents and information provided by the applicant and request additional information or any missing documents to complete the application.

Step 4: Drafting Forms, Finalization of the Application Packet, and Submission

We draft necessary forms, including G-28 and I-129, and share forms and any remaining support letters with the applicant to be signed and sent back to us. The applicant pays a filing fee if not already paid. We put the signed forms, support letters, and cover letters in the application packet and send them to the USCIS.

Step 5: Post-Submission Procedures

After submission, we provide the applicant with a copy of the application packet and receipt notice. Upon receipt, we also share the Application Support Center (ASC) appointment notice with the applicant, instruct them on what to expect during the ASC appointment, and ask the applicant to confirm their attendance at the ASC appointment. If a Request for Evidence is received, we discuss the response and necessary documents with the applicant. When additional documents are received, we draft the response and submit it to the USCIS.

Step 6: Visa Approval and Post-Approval Procedures

When the O-1A petition is approved, we send a copy of the approval notice to the applicant. We will also assist you in the post-approval procedures to make your American dream a tangible reality.

Dorukhan was my partner's lawyer and helped them with their case in the US. He did an amazing job helping them through their process. He and his team were always easily reachable, very thorough, and helpful throughout the whole process. Eventually, he became my lawyer, too, when my partner and I got married, and I couldn't have asked for a better and easier experience. I will definitely return to Oguz Law in the future for any needs that I have. Thank you, Dorukhan and your team!
