How Does the H-1B Application Process Work?

Step 5: Submitting the USCIS H-1B Petition
Once the LCA has been approved, we submit the H-1B petition to USCIS. This includes a full filing package, the necessary government fees, and Form I-129, a comprehensive petition letter outlining the company, the job, and the employee’s qualifications.
Step 6: Evaluation and Decision by USCIS
If more proof is required after reviewing the petition, USCIS may issue a Request for Evidence. After adjudication, a determination is issued by USCIS. The foreign worker may start working in H-1B status or apply for an H-1B visa at a U.S. consulate if they are not in the country when the employer gets a Form I-797 Notice of Action if the application is accepted.
