For years, the H-1B visa program selected people at random from a lottery to get one of the most sought after work permits in the U.S. Starting in 2026, the system will change.

The existing random H-1B lottery will be replaced with a new wage-weighted selection system that has just been finalized. This will completely change how H-1B candidates are chosen. This change will have an immediate impact on professionals from other countries, recent graduates, and U.S. firms.

It’s important to note that this fee doesn’t apply to small enterprises, nonprofits, colleges and universities, or employers who don’t have to pay it. This means that many startups, research institutes, and universities won’t have to pay this extra expense.

These adjustments are part of a larger shift in policy that puts higher-paying jobs first and makes it harder for big staffing businesses to file a lot of H-1B applications.

How the New H-1B Wage-Based Selection Works

Under the new rule, each H-1B registration will receive multiple “entries” depending on the Department of Labor wage level associated with the job:

  • Wage Level IV (highest level): 4 entries
  • Wage Level III: 3 entries
  • Wage Level II: 2 entries
  • Wage Level I (entry level): 1 entry

All registrations still go into the same selection pool, but higher-paying jobs have a better chance of getting one.

These wage levels are determined based on occupational data and geographic location using Department of Labor standards.

Important: Wage levels reflect relative seniority and job complexity within a specific occupation and location, not simply how much the worker is paid. Many H-1B workers earn salaries well above U.S. averages but may still fall into Wage Level I or II based on how the role is classified.

  • Prioritize highly skilled and highly compensated workers
  • Reduce perceived misuse of the H-1B system

Who Benefits and Who Faces New Challenges?

Senior Professionals and High Earners

People who work in senior, specialist, or management roles are likely to be successful. Higher pay means better chances of being chosen.

This is particularly favorable for:

  • Advanced technical specialists

Recent Graduates and Entry-Level Applicants

Most of the time, new graduates and people who are just starting out in their careers are in Wage Level I. They receive just one entry under the new approach, which makes it harder to choose statistically.

This may disproportionately impact:

  • International students on OPT
  • Early-career professionals
  • Startup hires with limited salary flexibility

For these applicants, other visa options (such O-1, L-1, or J-1 paths) may become more essential.

Employers

Employers will now have to plan ahead for:

  • Offered salary levels
  • Job classifications

Is There Still an H-1B Cap or Lottery?

Yes, the annual H-1B numerical cap still exists.

What changes is how registrations are selected. Instead of a purely random lottery, the system now uses weighted selection based on wage level.

There is still:

  • A registration period

  • Petition filing after selection

But randomness alone no longer determines outcomes.

Also, certain companies don’t have to follow the H-1B cap at all. These cap-exempt entities include:

Employees of these companies can apply for H-1B status at any time of year, and they don’t have to worry about the yearly quota or the lottery system. For many professionals, working without a cap can be a way to get into the U.S. workforce without having to go through the H-1B selection process.

  • Registration period: Expected March 2026
  • Selection results: Typically announced shortly after registration closes
  • Petition filing: Selected employers file Form I-129 with USCIS
  • Start date: October 1 (standard cap cases)

Once petitions are filed, premium processing is still available for quicker outcomes.
