Selection in the lottery does not guarantee visa approval, as the petition must still meet all eligibility requirements. Selected applicants are notified and invited to file a full H-1B petition within a specified deadline, typically 90 days from notification. 

If the cap is not reached after the first round of petitions, USCIS may hold additional lottery rounds to invite more applicants to submit their full petitions.

What Happens If I am Selected in the H-1B Lottery?

After successfully being selected in the H-1B Lottery, the next steps are;

Your employer needs to file an LCA (Labor Condition Application) with the U.S. Department of Labor. The LCA ensures that the employer is paying you the prevailing wage for the job and that your employment will not negatively impact other workers. 

Once the LCA is approved, your employer must submit a Form I-129 to the U.S. Citizenship and Immigration Services (USCIS) with all the supporting evidence. 

If the I-129 petition is approved, USCIS will issue an I-797 Notice of Action, confirming your approval for the H-1B status. 

If you are outside the U.S., after receiving your I-797 approval notice, you will need to apply for an H-1B visa at a U.S. consulate or embassy. This involves submitting Form DS-160 and attending an interview. After approval, you’ll receive an H-1B visa stamp in your passport. 

If you are already in the U.S. under a different non-immigrant status, USCIS may approve a Change of Status to H-1B without requiring you to leave the country.
