What Is EB-2 NIW?
I often advise clients on the legal aspects of obtaining a Green Card with the EB-2 NIW (National Interest Waiver) category without needing employer sponsorship.
This type of visa is meant for individuals whose work as highly skilled professionals could have a positive impact on American interests.
Someone who can demonstrate that their work or particular field has national strategic importance, and scientific or monetary value, can apply for permanent residency even without a job offer.
This path is particularly suitable for:
- Academics

How Does the EB-2 NIW Work?
The EB-2 category consists of two subcategories.
- EB-2A (Advanced Degree): This applies to those who possess a master’s degree or a higher one, or a bachelor’s with at least five years of relevant progressive experience.
- EB-2B (Exceptional Ability): This applies to practitioners who have reached a tier of exceptional ability or marked prominence in their field.
Candidates meeting one of these classifications have the option to apply for a National Interest Waiver (NIW) which allows them to bypass the employer sponsorship requirement.
In short: “If your work or project serves the national interest of the U.S., the government may grant you permanent residency without the need for a sponsor.”
At this point, the NIW process allows me to devise individualized legal plans for every client, as every client’s situation (every story, every project, every strength) is distinct. The NIW process is not one to use cookie cutter solutions.
How I Evaluate Eligibility
I always conduct a comprehensive eligibility assessment for every client before initiating an EB-2 NIW case.
This step is the most important in the process, and for good reason, every applicant’s background, achievements, and proposed endeavor varies.
I like to use a two step process for my assessments: (1) general eligibility conditions, and (2) the national interest criteria.
Who Can Apply for the EB-2 NIW Visa?
An applicant for the EB-2 NIW has to satisfy one of the two fundamental criteria outlined below.:
- Advanced Degree
- Holding a master’s, doctorate, or other advanced degree,
or - Holding a bachelor’s degree with at least five years of progressive experience in the field.
- Exceptional Ability
If you don’t have an advanced degree but possess exceptional achievements in your field, you must meet at least three of the following criteria:
- Official academic certificate or diploma
- At least 10 years of full-time experience
- Professional license or certification
- High salary or income significantly above the field average
- Membership in professional associations
- Recognition or awards in your field
- Other evidence (publications, patents, reference letters, media coverage, etc.)
What Is the National Interest Waiver (NIW)?
Normally, the EB-2 visa requires employer sponsorship (PERM labor certification).
However, by requesting an NIW, this requirement can be waived.
Essentially, you are telling the U.S. government: “My work directly contributes to the national interest of the United States. Therefore, removing the employer sponsorship requirement would also be beneficial for the country.”
Matter of Dhanasar Test: The Three Key Criteria
To be approved, every NIW petition is evaluated under the three key criteria established in the Matter of Dhanasar decision.
I analyze these criteria carefully for every case:
- Field of Substantial National Importance:
The applicant’s area of expertise must hold national-level importance in areas such as economics, health, environment, education, or technology. - Personal Contribution and Achievements:
The applicant must demonstrate that their past achievements, research, or innovations can significantly benefit the national interest. - Waiver of Job Offer Requirement:
It must be shown that the U.S. would benefit from the applicant’s work even without a formal job offer or sponsor.
The Step-by-Step Process
The EB-2 NIW process can be completed independently, without employer sponsorship, and generally consists of two main stages:
Document Preparation
At this stage, the applicant’s qualifications are meticulously compiled:
- Diplomas, certificates, and résumé
- Publications, awards, and reference letters
- A detailed description of the proposed project or endeavor in the U.S.
Form I-140 (Immigrant Petition for Alien Worker)
This form is filed with USCIS (U.S. Citizenship and Immigration Services) and outlines the applicant’s credentials, achievements, and contribution to the national interest.
After Approval: Two Options
- If outside the U.S.: Consular processing through a Consular Processing /DS-260 immigrant visa interview.
(When the applicant is abroad, consular procedures apply.) - If within the U.S.: Adjustment of Status through Form I-485.
Once approved, the applicant becomes a Green Card holder, obtaining permanent residency and work authorization in the United States.
